A U.S. District Court dismissed a lawsuit claiming Hershey's Reese's Halloween candies were deceptive because their packaging depicted spooky designs that were absent from the actual chocolates, ruling that the lack of design did not cause economic harm to consumers.
Oreo and Reese's, despite being owned by different companies, have collaborated to release two new products combining their flavors, driven by consumer demand and as a strategic move amid declining snack sales, with the products available in September and a permanent addition to their lines.
Four customers in Florida have filed a federal lawsuit against The Hershey Company, alleging that the packaging of certain Reese's Peanut Butter products is misleading. The plaintiffs claim that the designs on the wrappers suggest intricate carvings on the chocolates, which are not present in the actual products. They seek unspecified compensatory damages, arguing that the deceptive packaging influenced their purchasing decisions. The Hershey Company has not responded to requests for comment.
The Hershey Company is introducing the Reese's Caramel Big Cup, a new variation of their classic peanut butter cup that includes a layer of caramel. This comes in response to a Change.org petition started in 2021, requesting the return of Reese's peanut butter cups with caramel. The new candy will be available nationwide starting November 17th in standard and king size packages.
Reese's may be violating state and federal laws with its sweepstakes offer advertised on packs of peanut butter cups. The promotion states "You could win $25,000," but only after purchasing and opening the package can consumers see the small print stating that no purchase is necessary to enter. Consumer advocate Edgar Dworsky raised concerns about the lack of signs indicating no purchase is necessary in candy displays across multiple states. The Federal Trade Commission (FTC) stated it cannot comment on specific companies but enforces laws against "unfair and deceptive acts." Hershey Co., the owner of Reese's, has not responded to requests for comment.
