The US SEC has voted 3-2 to seek public comment on its proposal to expand the definition of an "exchange" to include decentralized cryptocurrency platforms, also known as DeFi platforms. The proposal, first introduced in January 2022, aims to capture many more venues for regulation beyond traditional exchanges. While some DeFi platforms may fall under the proposed definition, others may already be considered exchanges by the existing one. The move has raised additional questions for the sector, with many in the industry calling for regulatory clarity.

The US Securities and Exchange Commission (SEC) has reopened a proposal from last year that would now explicitly target DeFi platforms for crypto transactions as exchanges that need to be regulated. The updated proposal now uses more direct language that includes DeFi in the widening definition of regulated exchanges, and it details its estimates on how much that change is expected to cost the industry. The SEC is poised to “reiterate the applicability of existing rules to platforms that trade crypto asset securities, including so-called ‘DeFi’ systems,” according to an SEC fact sheet outlining the changes.

Products geared toward hedging interest rate risks will see more persistent demand, according to Piper Sandler managing director Richard Repetto, who met with 15 global exchange and trading companies’ management teams at the recent Futures Industry Association conference.
