
India's Supreme Court Rejects Same-Sex Marriage Recognition
The Supreme Court of India rejected the LGBTQIA community's plea for a statutory right to marry, leaving the decision on same-sex marriages to the government and legislature. The majority opinion, written by Chief Justice D Y Chandrachud, emphasized the regulation of marriage by the state to democratize its benefits and ensure social order. However, he acknowledged the need for legal recognition of civil unions among queer couples. The minority opinion, written by Justice S R Bhat, argued that courts should not assume the role of the legislature in conferring or denying legitimacy to marriages. Justice Bhat cautioned against prolonged inactivity by the government and legislature, stating that action in this regard would alleviate the feeling of exclusion experienced by the queer community.
