Premom Fertility App Faces FTC Order for Sharing Health Data with Advertisers.

The Federal Trade Commission (FTC) has charged fertility app Premom with deceiving users by sharing their sensitive personal information with third parties, including two China-based firms, and failing to notify consumers of these unauthorized disclosures in violation of the Health Breach Notification Rule (HBNR). As part of a proposed order, Premom would be barred from sharing users’ personal health data with third parties for advertising, required to obtain users’ consent before sharing health data for any other purpose, and must tell consumers how their personal data will be used. Easy Healthcare Corporation, which operates the Premom app, will pay a $100,000 civil penalty for violating the HBNR and will also be required to implement comprehensive security and privacy programs that include strong safeguards to protect consumer data.

Biden administration proposes stronger privacy protections for abortion seekers and providers.

The Biden administration has proposed new health privacy protections to prevent protected health information from being used to investigate or sue people who facilitate abortions. The changes would bolster reproductive health care privacy and strengthen existing privacy rule protections under the Health Insurance Portability and Accountability Act of 1996. The proposed rule would continue to allow a regulated entity such as a health insurance company or provider to use or disclose protected health information "for permissible purposes" under the privacy rule, but not when its primary purpose is to investigate or impose liability on any person for seeking or facilitating lawful reproductive care.
