Anthony Randall, an African American man awaiting a kidney transplant, has filed a lawsuit alleging that an algorithm used to determine priority for organs is biased against Black people. Randall is seeking millions of dollars in damages and a better position on the kidney transplant waiting list. He also wants to represent a class of 27,500 Black U.S. patients who he argues have been similarly disadvantaged. Both UNOS and Cedars-Sinai have dropped the use of the part of the formula Randall cites in his lawsuit. The lawsuit is the latest effort to challenge the policies and functioning of the nation’s troubled organ transplant system in recent years.

The system has been run by the United Network for Organ Sharing (UNOS) for nearly four decades, but the administration is now putting the network out to bid to foster competition. The administration also wants to end the current practice of UNOS board members sitting on the Organ Procurement and Transplantation Network's board, which is viewed as a conflict of interest. The overhaul also includes the rollout of a website that will provide detailed, de-identified data on transplant wait lists, donors, and recipients.

UNOS faces overhaul amid organ transplant network troubles.

The US government plans to overhaul the organ transplant system, including breaking up the monopoly power of the nonprofit organization that has run it for the past 37 years. The proposal aims to create a competitive environment in the history of the transplant system, install a strong board of directors independent of UNOS, create a public dashboard for the voluminous data the system generates, and bring more transparency to the sometimes opaque process of how patients and organs are matched. The Biden administration has committed $67 million in its proposed fiscal 2024 budget for what Johnson is calling a “modernization” of the transplant network.
