A federal appeals court has upheld the viability of the obstruction of an official proceeding before Congress charge that has been used against hundreds of people indicted in connection with the attack on the Capitol on Jan. 6, 2021. The decision means that the charge can continue to be used in the Justice Department’s prosecutions related to the Jan. 6 riot. However, the split decision left wiggle room for defense lawyers to try a flurry of complicated new efforts to invalidate the charge in all of the cases in which it has been used.
