Legal Challenge Looms Over Biden's Migrant Policy Allowing 200,000 Entries in 10 Months

A federal judge in Texas is reviewing the legality of a Biden administration program that has allowed over 200,000 migrants from Latin America and Haiti to enter the U.S. with American sponsors in the past 10 months. The program, which allows up to 30,000 Cubans, Haitians, Nicaraguans, and Venezuelans to enter the U.S. each month and apply for work permits, is facing a lawsuit from Texas and other Republican-led states seeking to shut it down. The outcome of the lawsuit will determine the fate of a key component of the Biden administration's border management strategy.

U.S. migrant sponsorship program reaches monthly cap with 1.5 million applicants.

Over 1.5 million requests have been received by the US Citizenship and Immigration Services (USCIS) from individuals hoping to sponsor the entry of migrants from Cuba, Haiti, Nicaragua, and Venezuela, overwhelming caseworkers and jeopardizing the Biden administration's objective of reducing border crossings. USCIS can approve no more than 30,000 arrivals under the program each month, and the backlog of unresolved applications has caused significant wait times for applicants. The program has been paired with a policy of returning illegal border crossers to Mexico, which has led to a sharp drop in illegal border crossings by migrants from these four countries.
