Retired judge Clark Erickson, a Republican, recommended to the Illinois State Board of Elections that Donald Trump should stay on the ballot in Illinois despite finding that Trump engaged in the January 6 insurrection at the US Capitol. Erickson concluded that the board lacks the authority to vet candidates based on federal constitutional considerations, but if they believe they do have the statutory authority to review Trump’s eligibility under the 14th Amendment, then they should remove him from the ballot. The decision will be voted on by the bipartisan panel, and can be appealed in Illinois state courts.
