"Probe Ordered for Juror Bias in Boston Marathon Bomber's Case"
A federal appeals court has ordered the judge overseeing the Boston Marathon bomber Dzhokhar Tsarnaev's trial to investigate claims of juror bias, without throwing out his death sentence. The court found that the trial judge did not adequately probe Tsarnaev’s allegations and sent the case back for a new investigation. If the judge finds that either juror should have been disqualified, Tsarnaev’s sentence could be vacated, leading to a new penalty-phase trial. Despite a moratorium on federal executions, the Justice Department continues to push to uphold the death sentence in Tsarnaev’s case.
