A federal appeals court has ordered the judge overseeing the Boston Marathon bomber Dzhokhar Tsarnaev’s trial to investigate claims of juror bias, potentially impacting his death sentence. The court did not throw out the sentence but found that the trial judge did not adequately probe Tsarnaev’s allegations of bias by two jurors. If bias is found, Tsarnaev’s sentence could be vacated, leading to a new penalty-phase trial. The case has already been argued in front of the U.S. Supreme Court, which reinstated the death sentence in 2022.
