Texas Contradicts Stance on Fetal Rights in Prison Guard Lawsuit

Texas officials, while defending themselves against a lawsuit filed by a prison guard who experienced a stillbirth while on duty, argued that an "unborn child" may not have rights under the US constitution, contradicting their previous support for restrictions on abortion. The guard and her husband are seeking restitution for medical and funeral costs, as well as pain and suffering. The Texas attorney general's office and the prison agency argue that the agency should not be held responsible for the stillbirth and question whether the fetus had rights as a person. The lawsuit will proceed, but the arguments over the rights of the fetus have not been addressed. The overturning of Roe v Wade has allowed states to enact restrictive abortion laws, leading to ongoing legal challenges.

Controversial Actions of Prison Officials and Judges in South Carolina

A former prison guard, Asia Love, who is named in documents detailing a convicted killer's early release, tried to visit him in prison after retiring, posing as his sister, but her request was denied. Love is mentioned in additional supporting documents related to the killer's release, and in 2019, she wrote that Officer Sally Fowler wanted the killer to "receive an award" for "saving her life." The killer helped the Department of Corrections by putting them on "notice" about a dangerous inmate who had escaped. The state attorney general is asking the South Carolina Supreme Court for a bench warrant to put the killer back in prison.

Illinois prison guard sentenced to 20 years for fatal beating of inmate.

A former Illinois state corrections officer, Alex Banta, was sentenced to 20 years in federal prison for his role in the beating death of a prison inmate in May 2018. Banta was caught up in the culture of silence surrounding violence against inmates, but there was no excuse for his treatment of 65-year-old Larry Earvin at Western Illinois Correctional Center. Banta expressed regret and took responsibility for his actions, but corroborated trial testimony that rough treatment of prisoners was not only condoned but expected at the prison in Mount Sterling.
