Virginia First-Grade Teacher Fights for $40M in Damages After Being Shot by 6-Year-Old

Abby Zwerner, a first-grade teacher in Virginia who was shot by a six-year-old student, appeared in court as she seeks $40 million in damages from Newport News Public Schools. Zwerner alleges gross negligence by school administrators, claiming they ignored warnings that the boy had a gun in his backpack. The school board argues that her injuries fall under workers' compensation, limiting her compensation to 10 years' pay and limited medical benefits. The judge will decide whether the case should proceed to trial or be handled by the workers' compensation commission. The mother of the six-year-old shooter is also awaiting sentencing for felony child neglect.

Controversy Surrounds Resignation/Firing of Virginia Teacher Shot by Student

Abigail Zwerner, the Richneck Elementary teacher who was shot by her first-grade student in January, resigned from her position with Newport News Public Schools effective June 12. The division sent Zwerner a standard exit letter on May 22, which is sent out to all teachers who are not returning the following year. In April, Zwerner filed a $40 million lawsuit against the School Board, asserting that administrators failed to keep the school safe. The division refuted claims that Zwerner was fired, stating that she notified them of her intent to resign in a March 13 email exchange with the human resources department.

Teacher Shot by 6-Year-Old Resigns from Virginia School District.

Abby Zwerner, the first-grade teacher who was shot by her 6-year-old student, has resigned from her job with Newport News Public Schools. Zwerner's lawyers claim that she has not been paid since February, and the school district tried to get her to take workers' compensation. However, NNPS says that Zwerner refused workers' compensation and exhausted all of her leave. Following the shooting, HR began processing workers' compensation for Zwerner, and she was on admin leave with pay until the workers' compensation payments began.
