SpaceX has filed a lawsuit against the National Labor Relations Board (NLRB), challenging the constitutionality of the board's structure after the NLRB accused the company of unlawfully firing employees who criticized CEO Elon Musk. The employees had sent a letter calling Musk "a distraction and embarrassment" and accused him of making sexist comments. SpaceX's lawsuit aims to halt the NLRB's case against it, arguing that the inability to remove board members and administrative judges at will is unconstitutional. This legal move follows a similar strategy SpaceX used to pause a Department of Justice case regarding hiring practices. The NLRB has not commented on the lawsuit.
