The Department of Justice (DOJ) plans to use Donald Trump's cell phone data from around the time of the Jan. 6 Capitol riot in his upcoming trial for election interference. Special Counsel Jack Smith disclosed that an expert witness will testify about how Trump used his phone on the day of the riot, including accessing Twitter. The data may help establish whether Trump personally sent or approved a tweet attacking then-Vice President Mike Pence during the riot. The filing also mentioned two other expert witnesses who will provide evidence on individuals' movements towards the Capitol and the gathering and use of location data. The DOJ has asked the Supreme Court to determine whether Trump has absolute presidential immunity in the case.
