Release of Suspect in Attack on Former SF Fire Commissioner Raises Questions.

The suspect in the assault of former San Francisco fire commissioner, Stephen Carmignani, has been released from custody due to Carmignani's inability to testify in court after being severely injured in the attack. The suspect, Garrett Doty, is charged with three felonies and is ordered to stay away from Carmignani and the entire block of Magnolia Street. The DA's office has not dropped the charges against Doty and a preliminary hearing has been set for May 23. The case has taken a new turn with the revelation of a video showing a man pepper-spraying sleeping unhoused individuals, which the public defender's office claims may be Carmignani. Doty's attorney claims he acted in self-defense and that Carmignani instigated the altercation.
