65-year-old man faces charges after fatally shooting alleged mugger in Queens.

A 65-year-old man in Queens, New York, shot and killed a mugger who was trying to rob him with a pen, which he mistook for a knife. The shooter, Charles Foehner, could face additional charges for using an illegal weapon. Foehner, who had a gun permit but not for the revolver he used, called 911 to report the incident and handed over the firearm to responding officers. The mugger, who had a criminal record, died at the scene. Prosecutors are still investigating the case.
